1. General

1.1. Is Mobile Data Now, Open Source software?

No, Mobile Data Now is a proprietary software application but utilizes some open source software.

Note: Mobile Data Now does offer free licenses for official Open Source Projects and non-profit organisations - it's our way of giving something back.

 

2. Purchasing

2.1. How much does Mobile Data Now cost?

Please see our current pricing information.

Discounts are available if multiple licenses are purchased together in a single transaction.

2.2. What is the process for ordering Mobile Data Now?

It's all very simple. From within the Mobile Data Now application, choose the licensing link and you will be sent to the secure order form. Once that is completed, your installation will be upgraded and a receipt will be sent via email.
If credit card details are not provided through the secure online form, the invoice can be paid by mailed cheque, faxed/phoned credit card or direct bank transfer.

2.3. Can I send through a purchase order?

Where possible, it is preferred that all orders are placed via our secure online purchase page (see above for details).

Procurement via a purchase order (PO) is still possible of course, but please bear in mind that the license key can only be accessed after payment is received and processed (A temporary license key will be issued until the PO is paid).
Upon receipt of a PO we'll issue your organisation with an invoice, reflecting your PO number.

The process for submitting a PO is to simply email or fax (+64 3 9631439) the PO to Mobile Data
Now, ensuring that the PO includes:

  1. The registered name of the licensee company:
  2. The registered address of the licensee company:
  3. The registered name of the billing company:
  4. The registered address of the billing company:
  5. The name of the billing contact: (yourself?)
  6. The email address of the billing contact: (yourself?)
  7. The name and email of the technical contact: (ideally the end user)
  8. The email address of the technical contact: (ideally the end user)
  9. The number of users
  10. The license type you are purchasing: Full license/Upgrade/Renewal
  11. The organisation type you are purchasing for: Academic/Commercial
  12. If any credit card details are to be sent with the PO, please also include:
  13. The card type, number, expiry, and name on card.

 

Note: if you are renewing or upgrading a license, please include a note with the email address of the current license holder and the license's creation date.

Once that is done, an invoice (referencing the PO #) and licensing agreement will be sent via email. If no credit card details are supplied with the PO, the invoice can be paid within 30 days by mailed cheque, faxed/phoned credit card or direct bank transfer.

2.4. Which payment methods are accepted, and what are your payment terms?

Mobile Data Now accepts the following payment methods:

  • Credit card (including MasterCard, Visa and American Express) via our secure online order forms/phone/fax
  • Paypal
  • Mailed cheque
  • Direct bank transfer

 

Mobile Data Now's payment terms are strictly cash only or 0 day. This means that the license key will only be issued after your payment is received.

If you have placed your order but find that you are waiting for your organisation to actually make the payment, you can contact us and request a fully-functional evaluation license key to help you cope with any bureaucratic delays.

2.5. Are there any discounts if I purchase multiple software licenses?

Yes! Mobile Data Now offers volume discounting for all orders consisting of more than 5 licenses, upgrades or renewals. The discounting is strictly limited to orders for multiple licenses placed in a single transaction. The relevant discount rates are found in the pricing section.

2.6. Are there any discounts for government organisations?

Discounts are not offered to government organisations (unless you are a provider of primary, secondary or tertiary education - in which case you would qualify for Mobile Data Now's academic pricing).

Government organisations purchasing Mobile Data Now software are required to purchase commercial licenses.

2.7. How is the software distributed? Will I receive a CD-ROM or shrink-wrapped product?

Mobile Data Now has adopted the Electronic Software Distribution (ESD) model. Consequently software is available only via HTTP download. Mobile Data Now do not distribute any software on CD, DVD or as a shrink wrapped product.

As all commercial and academic licenses include 12 months of software support and updates, the ESD model is the best way to stay up to date with the numerous software releases made available to you.

2.8. Can we get a refund or perhaps have an acceptance period in case we are not happy with the product?

Refunds and acceptance periods are actually not needed. Mobile Data Now provide a fully functional version of Mobile Data Now software for you to evaluate for free.
What you'll be using during your evaluation is what you'll be getting when you buy. In fact activating the commercial license involves simply purchasing the license key.
We can also provide you with an evaluation extension involving a license key for many users if you need more time to become confident in your decision to move ahead with a purchase (just contact us).
So please, take advantage of Mobile Data Now's liberal evaluation policy and be sure Mobile Data Now software is right for you and your team before proceeding with a purchase.

2.9. Are there any applicable taxes?

Mobile Data Now is an New Zealand based company. As such New Zealand must collect Goods and Services Tax (+12.5% on list prices) from all New Zealand based customers.
No other taxes are collected by Mobile Data Now.

As a New Zealand company, Mobile Data Now is exempt from withholding taxes in the USA.
Prices may be affected by organisations based in countries that do not have an income tax treaty with New Zealand and are therefore required to impose withholding taxes. If this applies to you, please contact us to discuss the potential implications.

 

3. Upgrading

3.1. How much does it cost to upgrade my software license?

3.2. How can I get my software upgrade?

You can upgrade Mobile Data Now at any time if you are currently paid up with your licensing. To get your upgrade, go to the download page and install the new version over your old version.

3.3. How difficult is it to upgrade between different versions?

The Mobile Data Now upgrade process is very simple, and all data is seamlessly transferred between different versions.

 

4. Software Renewal

4.1. What happens after the first 12 months?

After the first 12 months, your software use will expire and you will no longer be able access support or software updates. Renewing your software license is done purely at your discretion and can be renewed in advance of your license expiration to ensure uninterrupted access to the support and software updates.

Perpetual license holders can continue to use your software without additional charge.

4.2. How can I purchase a license renewal?

By accessing within the Mobile Data Now software, click 'Licensing' then 'renew'

 

5. Licensing

5.1. What are the conditions for an Mobile Data Now Academic License?

Mobile Data Now Academic Licenses are available only to legitimate academic institutions, including primary, secondary and tertiary institutions. Please see the academic licensing page for more details.

5.2. What are the conditions of a Mobile Data Now Open Source Project License? How can I apply?

The Mobile Data Now Open Source Project License is free for 5 users and is Mobile Data Now's way of giving something back to the open source community.

The Mobile Data Now Open Source Project License is issued only if the applying project can meet the following conditions:

1. The project is using an OSI approved license;
2. The project has a publicly accessible website;
3. The instance of Mobile Data Now, for which the license is being provided, is to be run on a publicly accessible web server.
Additionally, Mobile Data Now may request confirmation of an established code base and at least a
single software release.

5.3. What are the conditions for a Mobile Data Now Non-Profit License? How can I apply?

The Mobile Data Now Non-Profit License is issued at no cost to the qualifying organisation for as many users as they require.

The Mobile Data Now Non-Profit License is granted on condition that the applying organisation is an official non-profit organisation or charity. In addition, the applying organisation must also be
non-government, non-academic and non-commercial in nature, and not otherwise able to afford Mobile Data Now software.

On application for a non-profit license, Mobile Data Now may request proof that the applying organisation meets our described intention above and, where applicable, has been granted official non-profit status.

5.4. Would additional licenses be required if multiple instances of the software were to be installed on a single server?

No, additional licenses would not be required. Each license is based on the number of users.

5.5. Would additional licenses be needed if the software is deployed on a development server or staging server for testing purposes?

No, you can simply contact us to request an evaluation license for testing purposes on development or staging servers. If multiple instances are required for use in production, only then will additional licenses need to be purchased. It is important to note that violations of these restrictions can result in costly fines.

6. End User License Agreement

6.1. Our legal department would like to make some changes to your End User License Agreement (EULA). Is that ok?

Unfortunately, within Mobile Data Now's current price structure, we're unable to make any changes to our EULA. If you consider our pricing model and the costs of creating and managing individual agreements with each of our customers, you can begin to understand our position. Maintaining a standard EULA with all of our customers allows us to focus our resources on meeting our obligations under these agreements. Do keep in mind of course that our EULAs have been very carefully authored to be fair to both you and us.

There may be some issues that are not covered here or on the rest of this page. If so, please feel free to contact us.

6.2. Your EULA refers to the grant of publicity rights to Mobile Data Now. What does that mean? Can we change that?

Mobile Data Now list a small number of our customers on our website as examples of organisations using our software. All other disclosures about our customers (customer testimonials, case studies, etc.) are done so only after collaborating with and obtaining permission from our customers.

If you don't want us to mention your company name at all, just let us know and we'll add you to our list of companies requesting to not be party to any disclosures or forms of publicity (including our customer lists on our website).

6.3. The EULA is governed by the laws of New Zealand and gives non-exclusive jurisdiction to the courts of New Zealand. Can we remove this or change this?

We can understand the desire to engage in any litigation in a local and familiar legal system. No doubt, for many of the same reasons, we feel the same way too. Although we can't change this clause, we can say that the New Zealand legal system is a world class legal system and will offer us both protection and justice should the situation arise. That said, we have never entered into any litigation with any of our customers.

 

7. Customisations and Professional Services

7.1. Does Mobile Data Now have a professional services team who can assist with training, implementation and/or software customisations?

Mobile Data Now does not currently offer customers any professional services. Consequently, Mobile Data Now can not formally engage in or formally assist with customer training, implementations or software customisations.

7.2. Can I request a feature?
